The IRS released Rev. Rul. 2007-24, which addresses certain exchanges of insurance policies. It concludes that concludes that a taxpayer’s receipt of a check issued by an insurance company under a non-qualified annuity contract is treated as a taxable distribution, even if the check is endorsed to a second insurance company for the purchase of a second annuity. The transaction is not characterized as a tax-free exchange because there was no direct exchange or assignment of the original contract.
